Terms and Conditions Agreement

a. Ambassador Participation

By submitting the WEAR U Ambassador sign-up form, I am agreeing to the terms and conditions listed below:

1. By participating in the WEAR Campus Ambassador Program, I agree to comply with these Terms and Conditions. I hereby confirm that I am at least 18 years of age.
2. By agreeing to these terms and conditions, I am taking full responsibility for my online activity and deem WEAR as not liable should any of this information and consent be false. 
3. I am not an employee, agent, franchise, or partner of the company. I cannot act on behalf of the company. I do not have any authority to incur debt, obligation, or liability on behalf of the company.

b. Ambassador Commitments 

• I will promote and market WEAR products to students at my college or university, following the below guidelines to the best of my ability.  
• Share brand messages on social networks.
• Receive new products and provide photo or video content for promotional, social, or catalog use.  
• Share on-brand content using our brand handles @wearbyea and #WEARU
• Maintain WEAR’s high standard quality for content, messaging and visuals. 
• Participants must create and share content that is positive, respectful, and aligned with the values of WEAR. Content should not contain offensive, discriminatory, or inappropriate material. All content must comply with the terms of the social media platform being used.

c. Ambassador Consensus

• When using tagging @wearbyea and #WEARU, WEAR will own the rights to use the image for email marketing or website content.
• I will not share confidential information, including product launch details, product images, or ambassador materials
• I understand that I will not receive monetary compensation or gift cards for use of images or videos used on the company’s social media networks. I will not receive any financial or other compensation for product promotion through my social media network other than commission-based sales that result from purchases made with my promo code.
• No cash compensation will be provided by the company. 
• I will protect the company’s trademark by not reproducing the company’s name/trademark or any company materials for use in advertising without the written approval of the company.
• I understand that the performance of my services is designed to promote and create goodwill for WEAR, so I will ensure that there is no cross-promotion of other brands: (i) the content I create for WEAR will only feature the WEAR products and brand; (ii) I will not include WEAR products in any content that I create for other brands. 
• I will promote WEAR products on social media accounts by posting appropriate photos of marketing events showcasing the products. I will contact the company if a clear understanding of “appropriate” photos is needed.
• I will not refer to posts, gifted products, etc. as paid sponsorships, or advertisements. Gifted products are to be referred to as gifted and my status as a WEAR Ambassador is to be disclosed.
• I will post as often as I would like on my social media accounts and tag @wearbyea and #WEARU in each post that relates to WEAR products.  I understand that I have permission to repost an existing post by WEAR as long as I tag @wearbyea upon publishing the post. However, I understand that I cannot use any other content than my own. 
• I will not speak negatively about the brand or those you work with publicly. Please reach out to WEAR first with any issues or concerns info@wearbyea.com.
• I will treat other Brand Ambassadors with kindness and respect, especially in community chat forums. WEAR does not tolerate bullying or negativity under any circumstances.
• I will conduct myself in a manner that reflects the highest standard of integrity and responsibility in keeping with the reputation of the company. If I do not uphold these standards, I will be immediately removed from the Brand Ambassador Program and forfeit all promotional codes effective immediately.
• If I choose to leave the Brand Ambassador program, any photos sent to WEAR will remain in their database to use on their social media platforms and marketing campaigns.
• My content shall not feature alcohol or any drinks that resemble alcohol, nor drugs of any kind or nature.
• If the company terminates the Brand Ambassador program, I have the right to request any outstanding payouts from the month prior.
• I must be an *active* Brand Ambassador to remain in the program.
• I agree that the company reserves the right to cancel this agreement at any time.
• I have read the company’s privacy policy and I agree to these terms.

*active pertains to posting content frequently and having at least one sale per month.

d. WEAR Commitments

WEAR (Company) understands and agrees:

• Company will provide one free welcome gift upon entering the program. The welcome gift is chosen by the brand and varies by location. The Company is not responsible or required to provide additional products or gifts. 
• Company may provide additional free products to top performing Brand Ambassadors at its discretion.
• The Company will retain the rights to use any photos they send us or tag us in, even if the Brand Ambassador exits the program.
• The Company agrees to adhere to the Company’s privacy policy and these terms and conditions.
• The Company has the right to remove an ambassador at any time without notice and at the discretion of the Company. Reward, payouts, or points earned will not be returned to ambassadors who are removed from the program. 

e. General

• Either party may terminate this agreement immediately for cause or without reason upon written notice. The notice may be via email.
• WEAR may alter or discontinue the Brand Ambassador Program at any time.
• The Brand Ambassadors will not be treated as a company employee for any reason.
